What to Do After a Car Accident

Getting in a car accident is a stressful experience, but there are certain steps you can take to secure your rights and interests after a crash. If you or your passengers are seriously injured, call 911 immediately. If you do not need emergency assistance and it is safe to do so, move your car out of oncoming traffic. Whatever you do, do not leave the scene of a collision. Even if someone is hurt, you need to wait for help to arrive.

While you are waiting, and assuming you feel well enough, you may want to:

  • Check on the other drivers/passengers and exchange contact information
  • Take pictures of your vehicle, the other vehicle, and the scene of the accident
  • Photograph any injuries you may have
  • Talk to any potential witnesses and get their contact information
  • Write down what happened so you are ready to talk to the police

Once the police arrive, tell them what happened and be sure to focus on the facts, avoiding speculation. Write down the officers’ badge numbers and ask for a copy of the report. Once you have clearance to leave, we recommend seeking medical treatment immediately.

Even if you do not feel injured, you should speak to a medical professional. Sometimes, injuries emerge after the physical stress of the accident wears off.

If you are injured, please contact our Orlando car accident lawyers to discuss your case.

Types of Damages You Can Recover

While nothing can change what happened to you in your car accident, compensation can help you cope with and recover from serious injuries.

If someone else’s negligence caused your crash, you may be entitled to:

  • Compensatory damages – these damages cover medical bills, missed work, and other expenses (economic damages) and account for your pain and suffering (non-economic damages).
  • Punitive damages – these damages do not apply in every case, but they are meant to punish the wrongdoer and make an example out of them so other people do not behave similarly in the future.

If you lost a loved one to a car accident, you may be entitled to damages that are specific to wrongful death cases. These are sometimes referred to as special damages and can cover the cost of the decedent’s funeral, burial, and lost support.

Our firm will pursue maximum compensation on your behalf. Contact us online or call us at to get started.

Who is Liable?

Florida is a no-fault car insurance state, which means your insurance company should cover the costs of your injuries. If your insurance policy does not offer enough, however, you may be able to file a personal injury lawsuit against the person who caused your accident, which will require you to prove liability.

We can help you work with insurance companies and/or file an independent lawsuit and prove liability.

Why Choose Maaswinkel Law, P.A.?

At our firm, you will get the personal attention you deserve and have access to caring, compassionate advocates throughout your case. While we give you the support you need to get through this difficult time, we don’t back down from tough negotiations and we use our extensive experience to pursue the most favorable outcome in your case. You are our top priority.
